In these terms and conditions, “Pacific Mesa” is referred to as the “company”, “us,” or “we.” ‘You’ refers as user or a paying customer. If you are a company or another person who gives access to company products, you agree to take responsibility in full in case of damages or indemnification that could properly lie against the customer.
The Pacific Mesa web site (the ‘site’), the educational services made available through the site and the content (the ‘products’) are owned, operated and maintained, as applicable, by Pacific Mesa (‘we’, ‘our’, ‘us’, or the ‘company’). The site, products and content are, collectively, the ‘company products.By (a) using or accessing the company products, including, but not limited to downloading or accessing, (b) offering a content through the site or through software; you agree to the terms and conditions set forth in these terms of use (the “terms”)
By using this website or its products and services, you agree and warrant that you have read, understood, and agree to be bound by these terms. Channel Partners are appointed by company at different locations and are entitled to limited authority to represent company in the same location.
Appointments to Channel Partner follow this process:
· Interested Candidates send their CV to partners@pacificmesa.net with subject line: “Brand Ambassador”
· When you are shortlisted, there is a brief telephone interview.
· In the final step after a successful interview, candidates receive Channel Partner designation. The Offer Letter must be signed, scanned and emailed to partners@pacificmesa.net for acceptance and confirmation.
Benefits--Once appointed as Channel Partner, you are entitled to the following benefits:
·You can represent company in negotiating with interested customers taking prior approval from company.
· You can give seminars, address students and professionals on behalf of company to make them aware of programs offered by the company
· You will be entitled to Monetary Incentive of 25% of the earnings made by you through selling courses, live projects, and other training materials, upon the purchase is fulfilled.
All website content belongs to the company or its partners, affiliates or third parties. You may use the site, services and content for your own personal, non-commercial use only. You may download and print available material for your own personal, non-commercial use. You must not transfer any information from the website or produce derivative work which you can display, distribute or transmit.
We value and respect others intellectual property and expect our users to do the same. The entire contents of the site are protected by copyright and trademark laws. The owner of the copyrights and trademarks are Pacific Mesa, its affiliates or other third party license holders.
Website content, including text, graphics, code and/or software is copyrighted and belongs to company, therefore you may not duplicate, modify, publish or reproduce the content in any manner, Company does not take any responsibility for the content on other sites (except our partners and affiliates), that you may find when searching or accessing company products or services. You must refer to their privacy policy and terms of use documents. Additionally, company has the right to disable or prohibit access to users who do not respect others' intellectual property.
The service may be terminated by company at any time. company shall not be liable to you or any third party in any manner for termination of the service. In the event you should become dissatisfied with the terms of use or any modifications thereof, or with the service or the site, your only recourse is to discontinue use of the service, terminate your subscription, and give notice to us of these actions.
Upon termination, your right to use the service and the site cease immediately and company shall have no obligation whatsoever to retain, forward or make available to you any of the academic or non-academic material available on company.
You agree to defend, indemnify and hold harmless company, its parent entities, subsidiaries, affiliates, officers, and employees, from any and all claims and demands, including attorneys’ fees, due to or arising from your use of the site or the service. This includes academic content, non-academic content, assessments, course material and any other conduct related in any way to the service or the site, including but not limited to breaching any warranty or provision.
These terms of use and the relationship between you and company shall be treated as if entered into and executed in the jurisdiction of the State of California, USA. Company makes no representation that the materials and content on the site or relating to the services are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is strictly forbidden. Those who access the services or the site from other locations do so on their own initiative and risk and they are responsible for compliance with local laws. You must agree to make any claim or demand in written form within three weeks of the occurrence.
You agree that your completion of the registration procedure constitutes agreement to the terms of use and the privacy policy. Further, this is the entire agreement between you and company; and supersede any prior understandings, representations or warranties including, but not limited to, any nondisclosure agreements, purchase orders, license agreements, service agreements, invoices or other terms and conditions that you may provide to us in respect of the site or services.
